Criminal defense attorney Neil Shouse explains the California crime of Health & Safety Code 11357 HS, possession of dried marijuana greater than 28.5 grams or concentrated marijuana greater than 8 grams. More info at https://www.shouselaw.com/ca/defense/... or call (855) 999-7755 for a free consultation. Possession of marijuana for personal use is legal in California for adults 21 and over. However there are still laws which make the possession of marijuana illegal, under certain circumstances. One of those laws is Health & Safety Code 11357, also called HS 11357, or 11357 HS. Health & Safety Code 11357 makes it illegal to possess more than 28.5 grams of dried "flower" cannabis, or more than 8 grams of concentrated cannabis, such as hash or "dabs". For minors under the age of 21, possessing more than the legal amount of marijuana is an infraction, that can result in fines and possibly drug education classes. For adults over the age of 21, a violation of Health & Safety Code 11357 is a misdemeanor, with a maximum sentence of up to 6 months in jail if convicted. However some California counties do not enforce marijuana-related crimes, or only enforce them if there is a very large amount of marijuana. Other California counties do still prosecute marijuana crimes, and in one of those counties Health & Safety Code 11357 is a serious offense. An experienced drug crimes attorney can help fight charges resulting from marijuana possession. It's possible that the marijuana didn't even belong to the suspect, or that police violated the rights of the suspect with an illegal search and seizure.
