Deliver Us from Evil: E-Cigarettes and the PACT Act

In the last days of 2020 Congress passed, and President Trump eventually signed, an omnibus spending package that kept the federal government operating into 2021. Deep in that 5,593-page piece of legislation was the Preventing Online Sales of E-Cigarettes to Children Act, a short bill that added e-cigarettes to the 2009 Prevent All Cigarette Trafficking (PACT) Act. The law requires online retailers to verify the age of customers for all purchases; require an adult with ID to be present for delivery; label shipping packages to show they contain tobacco products; and comply with all state and local tobacco tax requirements. The law also requires the U.S. Postal Service to cease delivery of all e-cigarettes in 2021. This webinar will give an overview of the PACT Act and describe what this change in the law will mean for the future of online or delivery sales of e-cigarettes. The presenter will describe the potential preemptive language in federal law that restricts the ability of other governments to impose additional rules on shipping companies. He will also discuss how the 2009 PACT Act has affected delivery sales of cigarettes and loose-leaf tobacco, which could indicate what will happen in the online e-cigarette market going forward.
