A cease and desist letter is not going to be filed in court. Rather, this letter will be sent to the individual or business you have a conflict with to ask them to stop an activity that you believe is harming you, and the letter lets them know that if they do not stop, you will be pursuing legal action against them. These letters are meant to serve as harsh warnings, though they do not have any immediate legal consequences concerning the courts or other government agencies. Does this mean FFL or its agents have done something wrong? What lessons can you take from this to protect yourself, your brokerage and your team: #1 Do not recruit to money. See my video:    • Видео   #2 Even if it is legitimate, teach your people to not post income things on social media. In this day and age it can be really difficult. Recognition, is okay so far; "Congratulations on making $100,000, $250,000 etc". But don't exaggerate, mislead out flat out lie. "Making $40,000 in one day" Maybe you got a check for $40,000 in one day, but it probably was not 1 days worth of work. Even if it was, not everyone has the same results. #3 When you are licensed, think about everything you do with, "You see your honor..." You are responsible for people's livelihood both when recruiting AND with your clients. So make your decisions based on what you would have to say about it if you ended up in front of a judge. In my opinion: I think these people we're probably honest in their claims. I think its silly that this industry is the only one regulated like this, spend a few hours on social media and you will see EVERYONE from other industries saying how much they made with little or nothing to back it up and their results are not typical either. I think as much as I am a 'live and let live' I do think honesty and transparency are important. I think that although I'm not flashy like this, but i have to admit it can be tempting to WANT to do it. It's pretty exciting when you make good money, no matter what industry you are in. These people probably didn't know they were not supposed to do this. I think the saddest part about it is, it gives the industry a bad name. Again, I have no affiliation with FFL. I've never worked for them. I don't know anyone who does, other than the people that prospect me all the time on Facebook.
