Do you remember the dramatic arrest of DMK leader Senthil Balaji? The Supreme Court on Tuesday refused to grant bail on medical grounds to Tamil Nadu minister Senthil Balaji. Who was arrested in the alleged cash-for-jobs scam. Now what the court said while rejecting the medical bail is quite interesting. “ ""I checked on Google. It says that this can be cured by medication. There's nothing as such that's serious, otherwise, we would have seriously considered it… Nowadays, bypass is like appendicitis. A person comes home within two days. We are not satisfied with your illness,” The bench comprising of justices Bela M Trivedi and Satish Chandra Sharma said. Senior counsel Mukul Rohatgi, who appeared for the Tamil Nadu minister had said that Senthil had undergone a bypass surgery and was vulnerable to suffer from a stroke. ""The condition that a “sick” or “infirm” person may be released on bail does not require a particular threshold of sickness"", Rohatgi argued. Responding to which Solicitor General Tushar Mehta, representing the Enforcement Directorate, said, “70% of inmates would be sick if we go by only sickness.” Rohatgi then requested for withdrawal and sought liberty to apply for regular bail before the trial court. In the previous hearing, the apex Court had called for Balaji's latest medical reports after it was argued that the DMK leader is likely to suffer a brain stroke if not treated. Earlier, a bench of Justice G Jayachandran of the High Court had refused to release the DMK leader on bail accepting the contention raised by the probe agency that Balaji is an influential person who could tamper with the evidence and influence witnesses if released from custody. Senthil Balaji was arrested on June 14 2012 and he continues to remains a state cabinet minister. However, he does not hold a portfolio.
