Former Chief Justice of India D Y Chandrachud says bail before conviction should be treated as a matter of right, rooted in the principle of “innocent until proven guilty”. Speaking at the Jaipur Literature Festival during a session titled ‘Ideas of Justice’, Chandrachud said prolonged incarceration of undertrials for years is deeply unjust, especially if they are later found innocent. He made the remarks in response to a question by senior journalist Vir Sanghvi, who cited the Supreme Court’s recent denial of bail to activist Umar Khalid in the 2020 Delhi riots conspiracy case. Chandrachud, however, underlined that courts must examine cases in depth where national security is involved before granting bail. Explaining the legal reasoning, the former CJI said bail may be denied only on specific grounds — if there is a risk of the accused committing the crime again, tampering with evidence, or fleeing the law. If these grounds are absent, bail should be granted. Chandrachud also expressed concern that sessions and district courts often deny bail due to fear that their integrity might be questioned, which is why many bail matters ultimately reach the Supreme Court. He highlighted delays in India’s criminal justice system and stressed that if a speedy trial is not possible, the accused is entitled to bail.
