A lot of people don't realize that if they have pre-existing medical conditions, say they had a surgery in the past on maybe the same body part that they reinjured when they got into a motor vehicle accident, they may not think they have a claim. In the state of Maryland, any person that this happens to absolutely still has a claim. In Maryland, we have what's called the eggshell skull rule. Without getting into too much legal jargon, it basically means if a person had a pre-existing medical condition and then they reinjure that same pre-existing medical condition, the person still has a personal injury claim if their pre-existing medical condition was aggravated, reinjured, or substantially aggravated because of the motor vehicle accident. This happens all of the time and it is very important these types of cases, the insurance company may not believe an injured victim saying, well, well, hey, they were injured in the past. You know, they didn't suffer any new injuries from this motor vehicle accident. That's simply not the case.
