Body camera footage from 3 body cameras (Officer Adam Huot, Officer Morgan Cekalla, and Officer Beau Hughes) of a use of force incident involving Duluth Police Officers. Officer Adam Huot's employment with the Duluth Police Department was ended on June 5, 2017. An Arbitrator later awarded the reinstatement of Adam Huot's employment with the Duluth Police Department. Full video:    • [Full Video] Duluth PD Use Of Force Incide...   Location: Duluth, St. Louis County, Minnesota, United States Date: May 21, 2017 (Sunday) Duluth Police Department: Duluth Police Department Timeline of Events: May 20, 2017 at 2116 hours – Dispatch receives a call (ICR 17107351) from private security of two males lying in a stairwell located near an entrance from Superior Street at 21 West Superior Street . Three Duluth police officers respond; Officer Adam Huot, Officer Morgan Cekalla and Officer Beau Hughes, who was a recruit officer in training. Officers make contact and men agree to leave. May 20, 2017 at 2140 hours – Dispatch receives a call (ICR 17107371) of two intoxicated males at the Tech Village ramp located at 14 East 1st Street. The ramp attendant recognized the males as being previously trespassed from the property on March 6, 2017. The same Duluth police officers respond. The initial contact goes well, officers professionally address concerns. One of the men is told he will receive a citation for trespass and demands to be arrested. Officers handcuff the man behind his back and begin to escort him from the premise. During the escort, the man being escorted by police offers passive resistance by going limp and lying down on the floor. He states, ““I’m not going to make it easy for you.” Officer Adam Huot grips the handcuff chain and proceeds to drag the man approximately 90 feet across the floor and through a steel door striking the man’s head. Officer Huot did not immediately check the citizen for injuries or inquire about them. Officer Huot’s actions violate DPD policy and are contrary to any training. Later during the same shift, one of the officers who responded to and witnessed the incident, reports the use of force to his lieutenant, Lieutenant Tim Jazdzewski. This is in accordance with DPD policy. An investigation commenced. On May 21, 2017 Officer Huot was placed on paid administrative leave pending the investigation. Duluth Police Department Investigation Findings: The passive resistance offered by this citizen in this incident did not justify the use of force. Several alternative options were available to Officer Huot to facilitate for removal of the citizen - all of which would have provided more dignity and respect. Officer Huot’s actions were contrary to his training, department policy, and Officer Huot violated our Mission, Vision, and Core Beliefs by betraying public trust and our social contract with our community. Officer Huot was on progressive discipline for a previous use of force incident in which he was suspended. He was coached, counseled, trained, and given “Tools” to better manage conflict inherent to police work. The training included Crisis Intervention Training and instructor level training for Verbal Defense and Influence; Officer Huot had more training on de-escalation than most of our officers. Despite our efforts, Officer Huot acted outside of the scope of his training and department policy. Duluth Police Department Department Response: On June 05, 2017, based upon these incident facts, including Officer Huot’s prior discipline history, and with counsel from DPD Command Staff, I made the decision to end Officer Huot’s employment with the Duluth Police Department and placed him on unpaid leave. On June 21, 2017 the Duluth Police Union filed a grievance regarding the termination of Officer Huot. On February 27 and 28, 2018 an arbitration hearing was held at City Hall before Arbitrator Mario Bognanno. The Duluth Police Union was represented by Minneapolis attorney James Michels, and the City of Duluth was represented by Assistant City Attorney Nathan LaCoursiere. Arbitration decision: The Arbitrator ruled the use of force was unreasonable, violated Department policy and training, despite the ruling, he ruled to reinstate the officer without back pay and that he be given one final chance. The City maintains the termination is the appropriate remedy and will appeal the decision to District Court. Arbitration Award: IN THE MATTER OF ARBITRATION BETWEEN CITY OF DULUTH, DULUTH, MINNESOTA ("City' or "Employer") & DULUTH POLICE UNION, LOCAL NO. 807 ("Union") ... AWARD PO Huot's termination was not for just cause. As remedy, the City shall reinstate PO Huot as a Police Officer but without back pay and benefits, including seniority-related benefits. However, PO Huot's return to work as a police officer is made contingent upon the Duluth Police Department's receipt of any medical exam, drug screening and psychological assessments that the Department may require.
