Within 1-2 days the patient was experiencing significant back and abdominal pain. Calls to the doctor's office were returned by a nurse. A nurse told the patient she had spoken to the doctor and that these were "normal" postoperative complaints. The patient kept calling the doctor's office and was again reassured that this was normal. A week and a half later, when the patient could no longer stand up straight and was in excruciating and agonizing pain, he finally went to a local emergency room. During emergency surgery, they realized that the common bile duct had been cut and bile was leaking into the patient's abdomen. The original surgeon violated the basic standards of medical care by not telling the patient to return to his office for follow-up or telling the patient to go to the closest emergency room if there was a problem.
