Attorney explains why declaring missing mom Suzanne Simpson legally dead could take years

Attorney Joseph Hoelscher explained it could be a long while before the missing realtor is legally considered deceased if investigators are unable to find a body, despite having criminally charged someone with her death. “In Texas, you need to wait seven years after somebody is reported missing before it's presumed that they might be deceased,” said Hoelscher, adding that after that period of time has passed, it's another three years before the individual's estate can be closed. “You would have to get the court to essentially declare them dead and open a probate process, which can be done through circumstantial evidence to the Court's satisfaction," Hoelscher, who is not connected to Brad Simpson's criminal cases, said. "What satisfies a particular court is going to vary, but it's usually a very high standard.
