Why the Car Dealer Did Not Pay Off Your Trade On Time. When you trade in a car that it not paid off, two things happen. First, if you owe more than you are being offered, you are "under water" and the negative equity is added to the amount financed. Second, you are trusting the dealer to make the payoff to the lien holder before your next payment is due. And therein lies the problem. Once dealers get deals funded, they often lose the incentive to do things promptly. Once casualty is that payoffs on customer's trade-in are often done weeks, or months late. The consequences are that the customer will begin to get late payment letters from their lender, and their credit will take a hit. One solution to avoiding credit problems from a dealer's late payoff is for the customer to make the late payment themself, and then bring a claim against the dealer for having to cover the payment.
