On 9 June 2022, CIArb's West Midlands Branch organised the virtual discussion "Dispute Prevention and Resolution in Oil and Gas Production Sharing Agreements in Africa". Oil and gas developments in sub-Saharan Africa generally proceed on the basis of production sharing agreements entered into between state parties and international companies. Fundamentally concerned with the division of the value generated between the parties, such agreements sometimes give rise to serious disputes. How can they be designed to minimise the risk of such disputes occurring? Even where the parties themselves are unable to reach agreement, how can they be designed to ensure that the involvement of third parties does not itself lead to further controversy? In seeking to answer these questions, the seminar also considered the implications of the energy transition, both as a source of tension for oil and gas contracts and as a driver of further extractive activities which could learn from the experience of hydrocarbons.
