Loss of ETLS Preferential Treatment a) Goods lose duty-free and quota-free status b) Importing customs will apply full Common External Tariff (CET) duties c) Any duty waiver already granted may be withdrawn retroactively Payment of Duties, Penalties, and Back-Taxes a) Importer may be required to: b) Pay outstanding customs duties c) Pay penalties and interest In some cases, customs may demand retrospective payments for past shipments (This happened to three companies that I know). Seizure or Detention of Goods The goods may be: a) Detained at the border b) Seized pending investigation c) Released only after lengthy verification or payment of fines In some cases, leads to demurrage, storage charges, and supply chain disruption. Denial or Withdrawal of ETLS Approval Exporter may lose ETLS-approved product status or be suspended or even be delisted from the ETLS registry. Another one is that, future exports may be subjected to more thorough inspection. Reputational Damage and Loss of Market Trust. The importers and distributors may lose confidence in the exporter and that could terminate supply contracts The exporter may be flagged as high-risk by customs authorities across ECOWAS. There will be loss of Competitiveness in the ECOWAS Market leading to higher landed cost due to duties and delays and reduced-price advantage compared to compliant ETLS exporters.
