At 15, Lakeith Smith had his life take away from him because of the felony murder rule. He was prosecuted as an adult and sentenced to 65 years in maximum security (recently reduced to 55 years) after a police officer killed 16 year old A’donte Washingon during a burglary of a home. It was erroneously reported that A’donte exchanged gunfire with the police. Ballistic evidence contradicts that information. In this environment, police killings, even if deemed justified, are under tremendous scrutiny. It seems especially unfair to allow them to not only kill defendants but then punish their co-defendants for felony murder on top of that. This is a blatant example of systemic racism and we are fighting to save Lakeith’s life from this injustice in what we predict to be a long legal battle. A Rule 32 has been filed by Lakeith’s attorney and a hearing has been set for November, when the Judge will hear arguments and decide to approve or reject a retrial. If it is rejected, Lakeith will need to appeal to the state and possibly at the federal level, where Lakeith’s case can potentially set federal precedent. When the police arrived to investigate, the officer alleges that A’donte was carrying a gun. The police officer fired on him immediately, hitting him three times and killing him. The body cam footage shows that the officer did not warn A’Donte or tell him to drop a weapon before firing at him and that he fired four times in a second. The doctor who performed the autopsy admitted on the stand that the police department made him redo the autopsy report because it didn’t line up with the police officers story. (this is according to Adonte Washington’s father Adre. We need the court transcripts from the grandjury against the Millbrook Police Officers.) That officer was cleared of all charges and was allowed to remain anonymous. The trial and first appeal: Lakeith was represented by Attorney Jennifer Holton. He was held in a juvenile detention facility for three months and moved to maximum security at St. Clair when it was determined that he would be tried as an adult. In his trial in 2018, the jury saw a tall man instead of a young teenage boy. The trial lasted two days. Judge Sibley Reynolds is white. Chief DA CJ Robinson is white. The jury was white. Lakeith was sentenced to 65 years in prison. That same day, the judge sentenced a white man, Wesley Phelps 28, to several months’ probation after he killed a McCalla woman in a fiery crash following grand theft and a high speed car crash in 2016. Lakeith was punished for not taking a plea deal and rightfully fighting for his life and constitutional rights to a fair trial. In 2019, Attorney JD Lloyd was assigned by the court to represent Lakeith in an appeal. The State of Alabama reduced Lakeith's sentence by 10 years for a new total of 55 years. How is this conviction possible? Under the felony murder rule, Smith and the other three teenagers who participated in the break-ins were found liable for the death of Washington at the hands of the police. This law is implemented across the country and disproportionately affects Women and... black and brown children. 13 states, including Alabama can convict people for felony murder by third party. The language in the rule is subjective and can be used at the discretion of the DA, allowing for murders committed by police to be pinned on these select groups of people at higher rates. Currently: Lakeith is in maximum security with deathrow and life without parole inmates at one of the most dangerous prisons in the USA. He had the least amount of charges against him in comparison with two other boys who are serving in medium security, yet he received 65 years, while they pleaded out for 18 & 28 years.
