COLORADO DRUG LAWS Here are the top five things to know about Colorado’s drug laws. 1) It is legal for adults 21 and older to possess up to two ounces of marijuana for recreational use in a private residence. But possessing up to two ounces of marijuana in public is a drug petty offense carrying up to 24 hours of community service and up to $100 in fines. Convictions can be sealed one year after the case ends. 2) It is now a drug misdemeanor rather than a drug felony to possess up to four grams of certain narcotics such as heroin, ecstasy, cocaine, or methamphetamine. Courts typically grant a fine and probation, and convictions can be sealed two years after the case ends. And defendants who complete a diversion program may be able to get the possession charge completely dismissed. 3) Buying, transporting, or manufacturing drugs is usually a drug felony carrying prison time. Penalties range from six months to 32 years in prison depending on the severity of the case. 4) Common defenses to drug charges are that the defendant never possessed the drugs, that the police entrapped the defendant, or that the police found the drugs through an illegal search. 5) The only drug convictions that can never be sealed from your criminal record are level 1 drug felonies. Level 2 drug convictions can be sealed five years after the case ends. And level 3- and 4- drug felony convictions are sealable three years after the case ends.
