Originally broadcast June 18, 2025 Moderator: Glenn G. Lammi, Washington Legal Foundation Speakers: Professor Mario Loyola, Florida International University; Christopher D. Thomas, Holland & Hart LLP; and Chad Whiteman, Global Energy Institute, U.S. Chamber of Commerce About program: On May 29, 2025, the U.S. Supreme Court unanimously reversed a lower court decision in Seven County Infrastructure Coalition v. Eagle County, Colorado, a result that allows a railroad-line project to proceed after a long delay. The Court’s decision arrives at a time of unprecedented private and public investment in infrastructure and other projects, as well as intense debate over the environmental regulatory landscape. Our panelists will explain the Court’s reasoning, assess the decision’s near-and long-term impacts on environmental permitting and related litigation, and evaluate Seven County’s effect on the broader regulatory debate.
