Title: Legal Note on the Scope of Section 47 of the MRTP Act, 1966 and the Non-Appellability of OC Refusals Subject Whether the Urban Development Department (UDD) of the State Government can adjudicate disputes concerning the Planning Authority’s refusal to issue an Occupancy Certificate (OC) under Section 47 of the MRTP Act, 1966. Statutory Framework Section 47, MRTP Act, 1966 provides: “Any applicant aggrieved by an order granting development permission on conditions or refusing permission under section 45 may, within forty days… prefer an appeal to the State Government or to an officer appointed by the State Government…” Key Interpretation The appellate jurisdiction under Section 47 is strictly limited to orders passed under Section 45 (development permission). It does not extend to post-construction certifications such as Occupancy Certificates, which are governed by local building bye-laws and Development Control Regulations (DCR). Distinction Between Development Permission and OC Aspect | Development Permission (Sec. 45) | Occupancy Certificate (OC) Timing | Pre-construction | Post-construction Governing Provision | Section 45 of MRTP Act | DCR + Building Bye-laws Appeal Mechanism | Section 47 of MRTP Act | No statutory appeal under MRTP Issuing Authority | Planning Authority (e.g., BMC) | Planning Authority (e.g., BMC) State Government | Appellate (limited to Sec. 45) | No original or appellate role Judicial Context Kalra v. MHADA (2023: BHC-OS-1961-DB): The Bombay High Court held that “the State Government cannot decide whether or not to issue an OC if a society, a developer or an entity is otherwise in law entitled to it.” Integrated Spaces Ltd. v. MCGM & State of Maharashtra (WPL No. 29850 of 2024): In 2025, the Court permitted withdrawal of a writ petition to pursue an appeal under Section 47 of the MRTP Act. This was arguably a procedural concession and not a definitive ruling on the applicability of Section 47 to OC disputes. Strategic Framing for Appeal To render the appeal viable u/s 47, a developer may frame it as: “The Planning Authority is refusing OC due to impractical or ambiguous conditions imposed in the IOD/development permission. These conditions are incapable of compliance due to changed circumstances or procedural ambiguity.” This reframing shifts the focus from the OC itself to the validity and enforceability of the original conditions, which falls within the scope of Section 47. Analysis The refusal of an OC is not an order under Section 45 and is therefore not appealable under Section 47. The Urban Development Department cannot adjudicate OC disputes unless the OC refusal is tied to development permission conditions. If OC is denied despite compliance, developers and associations must seek relief through writ jurisdiction under Article 226 of the Constitution. Conclusion The Urban Development Department does not have jurisdiction to decide OC issuance under Section 47 of the MRTP Act. Interpreting Section 47 to cover OC disputes risks conflating development permission with post-construction certification, which are governed by distinct legal regimes. Jurisprudence and statutory design favor addressing OC disputes either by the Planning Authority or through constitutional remedies—not by invoking Section 47. However, if the OC refusal is directly linked to impractical or disputed IOD (or development permission) conditions, a developer may strategically invoke Section 47 to challenge those conditions. In such a case, the appeal should be framed as a challenge to the development permission conditions, not as an appeal of the OC refusal per se.
