Alright, let’s get into this rollercoaster ride of a DUI case. When the cops mess up, you better believea a motion to suppress or dismiss is in the works. In lawyer talk, a 'motion' just means I’m politely (or not so politely) asking the judge to fix what went wrong. And sometimes that means I’m going to mention that the cop's version of the story is 'questionable.' Enter the case of Duke v. State. Duke gets pulled over for allegedly driving under the influence, and his defense attorney filed a motion to suppress the stop – the first step to getting that DUI charge tossed out. The cop testified and the judge wasn't buying it, and the case bounces to several courts from there. The awesome lesson we'll learn in today's video is that a judge hearing a motion to suppress gets to assess the credibility of witnesses right then and there--as they are testifying.
