A major victory has just been secured in the fight for due process and individual rights. In a recent charging order hearing, a judge made a critical and legally sound decision that establishes two powerful precedents for anyone facing council tax enforcement. First, enforcement cannot proceed without a "perfected order" from the court itself. Second, it is unlawful to charge interest on council tax charging orders. For years, councils have used their own internal paperwork and lists as a basis for enforcement, a practice that has now been successfully challenged. This ruling affirms that mere council-generated evidence is not sufficient. A judge must be satisfied that a legitimate, underlying liability order was properly made by the magistrates' court. To prove this, the court must produce a "perfected order"—a formal, written document from the official court record.
