If you look in Section 30.1 of the U.S. Foreign Trade Regulations, you won't see the term “exporter” listed. Instead, you'll find the term U.S. Principal Party in Interest, or USPPI. The U.S. Census Bureau made this change more than 20 years ago to clarify documentation responsibilities, to identify the data the USPPI is responsible for reporting and to create conformity in document issuance. This change has caused confusion among many companies trying to understand who is legally defined as the USPPI for their shipments. The U.S. Census Bureau defines the USPPI as the person in the United States that receives the primary benefits, monetary or otherwise, of the export transaction. That person can be: —The U.S. seller, the wholesaler or distributor, of the merchandise for export. —The U.S. manufacturer if selling the merchandise for export. —The U.S. order party if the order party directly negotiated between the U.S. seller and foreign buyer and received the order for the export of the merchandise. —The Foreign entity if they are in the U.S. when items are purchased or obtained for export. Who cannot be the USPPI? The forwarding agent or consolidator, with one specific exception. A freight forwarder acting as a customs broker and arranging import clearance of goods can be the USPPI if those goods are exported without change. Now, let's break down the responsibilities of the USPPI, especially in a routed export transaction. The Foreign Principal Party in Interest, or FPPI, must grant authority for filing the EEI through AESDirect to someone in the U.S., typically the USPPI or the freight forwarder. If the USPPI isn't the party granted authority to file, they must provide 12 pieces of information to the freight forwarder. These include: 1. Name and address of the USPPI 2. USPPI's Employer Identification Number 3. State of origin 4. Foreign Trade Zone, if applicable 5. Commercial description of commodities 6. Origin of goods indicator: Either Domestic (D) or Foreign (F) 7. Schedule B number or HTSUS code 8. Quantities and units of measure 9. Value 10. Export Control Classification Number (ECCN) or sufficient technical information to determine the ECCN 11. All necessary licensing information 12.
