Mark: Hey, good morning. A question for you guys is, my mom just purchased a house, she's turning about 70 years old, and the biggest question—she has equity in it—what is the best way? She currently does not have a will in place, but is it some form of a trust or a lady bird deed or something that would put it just in case she passes? I have two other brothers and stuff, though. Attorney Tom Olsen: Mark, we're all about helping people to avoid probate here at the Olsen Law Group. We consider a trust to be a complicated tool for avoiding probate. A lot of our clients can use simple tools to avoid probate. You are absolutely right, Mark. To avoid probate for your mom, probably it's going to be using not a trust, but a simple lady bird deed. That lady bird deed would state that as long as your mom is alive, it is her home to do with as she pleases, but upon her death, that home would automatically go to her three children, no headaches, no hassles, no probate. Mark: Perfect. Is that a pretty quick process as far as it's just the consult and then do the paperwork and all that for you guys? Tom: Yes, you can call us. We can do the initial consult over the phone or in person, whatever you prefer. We would then prepare that lady bird deed. It does need to be witnessed and notarized, so if your mom could come to our office and she signs it, we'll witness and notarize it for her, but otherwise, we can email you the deed to you, and she could sign it outside the office if she arranges for her own witness and notary.
