59. Missing Person

This presentation is about missing persons and about law governing such persons or their legal representatives. If a person goes missing, naturally family is worried. They search for the missing person. sincerely they search for him one or two days and as a last resort they lodge complaint to the police and consequently police will register the case and file the FIR before the magistrate and take up investigation.This is one part of the legal formality.. The next question is how to succeed to the property of misssing person's property, bank accounts, fixed deposit, how to get his/her salary dues and pension and how to change the khata/ account of the properties of the missing person. Section 108 of the Indian Evidence Act contemplates about the presumption of death of a person in case person is not traceable for more than 7 years. After the lapse of the said 7 years from the date of missing, if that person is not traceable, it is open to the family to file a civil suit before the Civil Court of competent jurisdiction to get a declaration to that effect.
