Presented by Sarah Barry and Kenn Neeley This CLE will update you on the DOJ Guidance for Justice Department Attorneys regarding student loan undue hardship bankruptcy litigation. The speakers will discuss the changes this guidance brings including its objectives, new process and direction to DOJ attorneys on assessing whether a student loan debtor meets the Brunner Test. Come learn about the successes in student loan dischargeability under the new DOJ guidance. Kenneth L. Neeley is a passionate entrepreneur and the owner of the Neeley Law Firm, PLC – a bankruptcy and debt resolution firm located in Chandler. He loves all things techie or creative (or preferably both). His clients appreciate how well he can explain debt relief options in plain language. Yet, for some reason he has a much harder time explaining himself to his wife in plain language. Fortunately, she still seems to understand somehow. He has five amazing kiddos, ages 9 to 20. Professionally, he is most proud of his awesome staff and his two published appellate wins for consumer debtors: In re. Gray, 523 B.R. 170 (9th Cir. BAP 2014) and In re. Neidorf, 534 B.R. 369 (9th Cir. BAP 2015). SARAH BARRY Sarah learned the ropes of student loan dischargeability as a paralegal with Neeley Law Firm, PLC while waiting for her AZ Bar admission. Now, she’s licensed and ready to be a compassionate advocate for the firm’s student loan clients. She spends her free time perfecting her negotiation and arguing techniques with the help of her teenage son, though she admits that he sometimes wins by default.
