In New York State Rifle & Pistol Association v. Bruen (2022), the Supreme Court invalidated a New York law that required individuals to show a specific need for defense in order to obtain a concealed carry permit. A year later, Hawaii gun owners and the Hawaii Firearms Coalition challenged Hawaii's own gun law, enacted after the Bruen decision, which prohibits individuals with concealed carry permits from carrying on private property open to the public unless they have the owner's explicit permission. The U.S. Court of Appeals for the Ninth Circuit upheld the Hawaii law and refused the challengers' request to rehear the case. Now the Supreme Court has taken up the case and will consider whether the appeals court erred in holding that Hawaii may presumptively prohibit concealed carrying in this manner. Featuring: George A. Mocsary, Professor of Law, University of Wyoming College of law; Founder & Director, Firearms Research Center * * * * As always, the Federalist Society takes no position on particular legal or public policy issues; all expressions of opinion are those of the speaker.
