National Labor Relations Board 361 N.L.R.B. 132 (2014) Most collective bargaining agreements provide for arbitration of contract grievances. The same conduct that's the subject of a grievance may also form the basis for unfair labor practice charges. In such cases, the National Labor Relations Board may choose to defer to the arbitrator's decision resolving the grievance. In Babcock and Wilcox Construction Company, the board considered when it should defer to arbitration decisions. Coletta Benelli worked for Babcock and Wilcox and was also a union steward. Babcock fired Benelli, allegedly, for violating safety regulations. Benelli and the union pursued a grievance over Benelli's firing, claiming that the discharge violated the applicable collective bargaining agreements prohibitions on retaliation for union activity and termination without cause. The grievance review subcommittee that arbitrated Benelli's grievance found that Babcock had fired Benelli for cause. The decision didn't mention Benelli's retaliation claim. Benelli filed unfair labor practice charges with the board, alleging that her discharge was retaliatory and, therefore, violated the National Labor Relations Act.
