As petrified passengers hid behind baby strollers and flooded to one end of the subway car, when Neely threatened to kill, Penny jumped into action and with the assistance of other passengers, placed Neely in a sleeper hold to subdue him until the train could reach the next stop for police to arrive. Despite the fact that first responders found a pulse, administered Narcan, and Neely was breathing when they arrived, after Neely died, Penny was charged with manslaughter & negligent homicide and faces up to 15 years in prison.
