On our jury selection series we have been talking about the importance of jury selection in a criminal trial. In many ways, jury selection is the most important part of the trial. Why? Because you get to talk to the people that will be judging you! Find out what they believe, what their prejudices are, are they willing to follow the law? Who are your friends and your enemies. Remember, the goal is to strike for cause the crazy people that will not follow the law and cut the other people that don’t like you! This is important you listen to everything they say! Get the jury talking! Today, I want to talk about how to handle criminal jury selection if you are facing a violent crime. Maybe you or a loved one have been charged with a violent crime but you did nothing wrong. Maybe you acted in self-defense. The problem is that jurors will sometimes have a hard time understanding how to determine if you acted in self-defense or not. How do you put the juror in the place of the accused? How do you get them to believe that you acted in self-defense? Let’s dive in to a few examples of questions our law firm has used during jury selection to make the jury see things from a different perspective. It is a combination of educating the juror about the law of self-defense while also putting the jurors in the shoes of our client so that they will 1. Believe them to be innocent 2. Apply the concept of proof beyond a reasonable doubt to a self-defense case 3. Understand what the government must prove regarding self-defense 4. Empathize with our client so they can related and understand why they did what they did Let me walk you through the questions: (Discover those jurors that can conceive a situation in which they would do what your client did or what you want your result to be – you must force the jurors to crawl inside the skin of your client and consider their position.) 1. Can you conceive of a situation in which you might take the life of another human being yourself? 2. Are you married? If so, could you conceive of taking another person’s life to protect your family? a. Almost everyone will agree with this – if not, strike them off the jury 3. Then ask another person what they think about that? Would you expect the law to prosecute you and charge you with a crime if you protected yourself or your family? 4. You would expect the law to understand your situation. 5. If you shoot someone to protect another, do you realize you would be in the same situation that Ms. Jones is in now? 6. What would you think of that? 7. Would you feel like you might have to prove your defense of self-defense? 8. How many of you think you would have to prove your self—defense? 9. How would you do that? Testify? Now explain the risks of testifying and how people can misinterpret you, judge you or not like you for things that have nothing to do with your innocence. 10. What of the law that will be given to you by the judge that says every element and item of the case must be proven beyond a reasonable doubt by the government and every person charged with a crime in US is not required to prove anything. 11. What about that law? Does that seem fair? 12. Now educate the jury on the law of self-defense – what did you think Mr. Juror when you heard the prosecutor and the judge say that the government must prove beyond a reasonable doubt that Ms. Jones DID NOT act in self-defense? 13. What should you do if you get in the jury room and you are sitting around with 11 of your best friends and they look at each other and say, I’m confused – I don’t know what happened! Good lawyers can crack the surface and have them see what you did as reasonable. The moment they can relate to you, it is 10x harder for them to judge what you did.
