In a significant judgment in Shivangi Bansal vs Sahib Bansal (2025), the Supreme Court has ruled that no immediate arrest shall be made in cases filed under Section 498A IPC (cruelty by husband or his relatives). 🛑 Instead, a 2-month cooling-off period will apply after the FIR is registered. During this time: ✅ The case will be referred to a Family Welfare Committee (FWC). ✅ The police cannot arrest or harass the accused. ✅ The FWC will conduct an independent review and submit its report to the Magistrate. ✅ Action will be taken only after the report is submitted. This ruling stems from an Allahabad High Court judgment that provided guidelines for constituting FWCs, which the Supreme Court has now upheld. ⚠️ In this particular case, the wife—an IPS officer—had filed six false criminal cases, including a fabricated attempt to murder charge, against her husband and in-laws.
