Doctor REFUSED to Answer My Questions Yes or No During His Deposition- Learn What I Did https://www.oginski-law.com NY Medical Malpractice & Personal Injury Lawyer Gerry Oginski Explains 516-487-8207 Email: Gerry@Oginski-Law.com I was questioning a doctor during his pretrial deposition. That's a question and answer session that takes place in the attorney's conference room. There's no judge there. There's no jury there. Just me, the doctor, his attorney and the court stenographer. I was asking the doctor very specific questions. Questions that called for a yes or no answer. It would have been so simple and quick if he just answered my questions either yes or no. Instead, he wanted to explain. Every single answer. A long-winded explanation. I had to stop him repeatedly. "Doctor, did I ASK YOU to explain?" "Well no, but I wanted to tell you how..." "Let me ask the question again doctor. Did Mrs. Jones make any complaint of X, Y or Z?" "Well, I can't answer that, but let me tell you why I didn't ask her that exact question..." "Doctor, did I ask you to explain ANYTHING?" "Uh, no." "Great. Let me ask you that question again..." Over and over. The doctor intentionally tried to explain every single answer. Each time he did, I interrupted him and brought him right back to my question. A very specific question. One that ONLY called for him to answer YES or NO. If the doctor simply answered my questions instead of trying to explain, his deposition would have ended hours earlier. Instead, he clearly was following his attorney's instructions to explain any time he could. That's not always a great strategy. Watch the video to learn more...
