TEXAS FAMILY COURTS HAVE SPECIAL RULES AND DO NOT NEED TO FOLLOW THE US OR TEXAS CONSTITUTIONS This is a recording of a hearing before Judge Dale Tillery of the 134th District Court in Dallas, Texas. For the sake of conciseness, some silent portions -- but NO dialogue or arguments -- were edited out. Two matters were brought before Judge Tillery. Pro se litigant and Plaintiff Bradley Miller was seeking a continuance, and Attorney David Findley (himself also a Defendant), who represented Virginia Talley Dunn -- Mr. Miller's ex-wife, who has been keeping their daughter away from Mr. Miller for over three years -- was trying to get Mr. Miller labeled as a "vexatious litigant." The background for this case stems from two "family" law orders issued by Judge Andrea Plumlee and her Associate Judge, Danielle Diaz. Mr. Miller had removed the case to federal court, and prior to it being remanded back to Judge Plumlee's state court, she and her Associate Judge issued orders when her court had absolutely no jurisdiction over the case. By all appearances, the order was not only void, unenforceable, and without any legal authority, and Judge Plumlee and Judge Diaz appeared to be acting under the color of law to deprive Mr. Miller of his civil rights, clearly justifying Miller's Section 1983 lawsuit. Mr. Miller has been fighting to see his daughter. His ex-wife, Virginia Talley Dunn, has been keeping her from him for three and a half years. Judge Plumlee and others appear to have conspired against Mr. Miller to try to severe the father-daughter bond, which violates Texas state policy. Two things are simply astounding: 1. Scot Graydon, from the Texas Office of the Attorney General, is actually DEFENDING the criminal actions of Judge Andrea Plumlee. In other words, he is defending the indefensible. 2. David Findley, representing Virginia Talley Dunn, who is withholding Mr. Miller's daughter from him, is trying to get the judge to declare Mr. Miller a "vexatious litigant." I wonder if Mr. Findley is also going to try to get Mr. Miller labeled a "deadbeat dad." MR. MILLER is being criminalized for protesting apparently illegal orders and for wanting to spend time with his daughter. This is the height of injustice.
