If you have spoken to the case worker or to the police about this case, don’t worry. We can still help you. I would have suggested that you don’t speak to the case worker or to the police but tell them, you want to talk to your attorney first and then you will get back to them. Just be polite and you do have a right to have an attorney whenever the police or any government official wants to talk to you. a dependency and neglect case arises when someone complains to the department or a criminal case is filed and the department of Human services gets involved in the care and custody of your children. They have several options. They can either remove your child but they need a court order for that or with your consent, they can keep the child at your home, place it with a relative or place it at a foster home. Now, we’ll take about all of the detailed processes in another video. But today I am going to concentrate on the participants of a dependency and neglect case. First is the Department of Human Services or Child Protective services, they have various names in each state. In Colorado, it is called DHS. They have their attorney which is the county attorney involved in child welfare cases. This is also a child welfare case too. Then you have guardian ad litem. Under Colorado, each child is entitled to have the assistance of a guardian ad litem who must be a lawyer. In some courts and in some cases, a CASA worker is appointed. That is a Court Appointed Special Advocate that is appointed for all of the children. Their job is to give an unbiased fair opinion to the judge so that the judge can have a third-party view on the case as to the care and welfare of the child. Now, each parent is also entitled to a lawyer if they meet the financial criteria. If you don’t meet that then you can either go pro se or hire a lawyer like us. I would ask you to call us if a case worker has come to meet with you or a police officer has come to meet with you regarding your children, I would advise you not to talk to them and if you have, it’s fine, we can still help you. but remember, I can’t help you if you don’t call me.
