https://www.millerandzois.com/burn-in... The settlement value of a burn injury is heavily dependent on the severity of burn. Burns are generally classified into 4 degrees of severity with 4th degree being the most severe. First degree burns are the least serious category of burns. A first degree burn involves damage only to the outer, superficial layer of the skin. First degree burns are comparable to a sun burn. First degree burn injuries have little to no settlement value in a lawsuit. A second degree burn occurs where the damage extends past the superficial outermost layer of the skin and goes deeper into the underneath layer of the skin called the dermis. Second degree burns leave the affected area of skin bright red and swollen. Second degree burns may or may not completely heal depending on how deep the damage is. Some 2nd degree burns can cause permanent discoloration and scarring. Normally, second degree burns have a very low settlement value of $10,000 or less. However, if they leave permanent scarring 2nd burns can have a much higher value depending on where the scarring is. A 2nd degree burn with permanent scarring on the face can easily have a 6 figure settlement value. A third degree burn classification applies when both the outer and underneath skin layers are completely damaged. 3rd degree burns are what we most commonly see in car accidents. 3rd degree burns are very serious. They can be immensely painful and they leave the victim’s skin scarred and badly disfigured. The average settlement value of a 3rd degree burn can range from $200,000 to $800,000, but cases involving major facial disfigurement can be worth several million. 4th degree burns are the most serious as the damage goes beyond both layers of the skin and into the subcutaneous tissue. 4th degree burns are often life threatening because they release deadly toxins into the bloodstream. 4th degree burns on limbs will almost always require amputation. If the victim survives a 4th degree burn, the damaged area is left black and charred in appearance. 4th degree burn cases have the highest average settlement value and. Putting a dollar range on 4th degree cases is difficult, however, because so many end up being wrongful death or amputation cases.
