Everyday we get calls from clients asking what they can do if a debt collector is pursuing them for a debt they don’t owe. This situation is surprisingly common. It can happen because someone made an accounting error, because you’ve been the victim of identity theft, or the debt collector is actually pursuing someone else who has a similar name or social security number. Regardless of whether this mistake is made in good faith or not, you should not have to put up with the harassing phone calls, emails, and letters, or the damage they might inflict on your reputation or your credit score. So, what should you do if this happens to you? Well, the first thing to do is politely inform the debt collector of their mistake. If you receive written correspondence, you have 30 days to ask for a verification of the debt in writing. If you receive a phone call, you can simply inform them over the phone and ask that they remove you from their calling list. Do not give out any additional information, as this can lead unscrupulous debt collectors to your assets or give them other reasons to contact you. If the debt collector continues to pursue you then you may wish to consider contacting an attorney as the debt collector may be violating collection laws. There may be criminal or financial punitive implications. If the debt collector continues to pursue you or even causes you damage, like harming your health due to stress, causing a loss of money at work, or causing other injuries, you can file a lawsuit against them. In this case, you would be entitled to not only your actual damages, but also statutory damages of $1,000 and a reimbursement of your attorney fees and costs.
