The defense asked for a mistrial. The judge said no. But he's not done. During the Day 12 morning hearing in the Kouri Richins murder trial, Judge Mrazik denied the defense's mistrial motion over an alleged Giglio violation involving star witness Carmen Lauber's drug court supervision. But his ruling came with a condition: the prosecution must recall Lauber to the stand so the defense can cross-examine her about a potential probation violation in November 2023, one she may have lied about to another judge. Watch both sides fight over how much of Lauber's police interviews the jury gets to see, and pay attention to what the defense discovers in new evidence received just before this hearing. Then listen for the moment defense attorney Nester tells the court she needs time to consult with Kouri because there are decisions the client needs to make. --- WATCH WITH JUSTICE 0:10 to 2:08 - Judge Mrazik explains the overnight developments. The state abandoned its original strategy and narrowed to a Rule 106 completeness argument on just two exhibits. 2:09 to 18:20 - The first exhibit fight. Both sides argue line by line over how much of Carmen Lauber's May 2023 interview the jury hears. The state wants the full emotional context. The defense wants the bare minimum. 18:21 to 26:17 - Mrazik rules section by section on Exhibit 8-58R. The "get out of jail free card" passage and the "three little boys" reference both survive defense objections. 26:18 to 33:27 - The fight over Exhibit 8-62R. Lewis tries to keep grand jury references away from the jury. Mrazik says no. That reference stays in. 33:28 to 38:22 - The two biggest rulings of the morning, back to back. Mistrial denied. Lauber ordered back to the stand at 1:00 PM. 38:23 to 43:32 - Lewis reveals new impeachment ammunition: a letter where Lauber told a judge she was in "100% full compliance" with drug court. The defense now has evidence that may not be true. 43:33 to 45:36 - Scheduling reveals the endgame. Only two witnesses left. Nester requests 30 minutes with Kouri after the state rests. Decisions are coming. FROM THE DESK OF JUSTICE: https://www.justiceisaprocess.com/des... CASE BACKGROUND REPORT: https://justiceisaprocess.com/ut-v-ri... 📖 CASE BACKGROUND On March 4, 2022, Kouri Richins called 911 from her Francis, Utah home at 3 a.m. Her husband Eric was unresponsive. Toxicology revealed five times the lethal dose of fentanyl. Eric had no history of drug use. Prosecutors allege Kouri had been taking money from Eric for years. They say she owed lenders more than $1.8 million and had opened nearly $2 million in life insurance on Eric without him knowing. Eric discovered the financial issues in 2020. He changed his will, created a trust naming his sister as trustee, and removed Kouri as beneficiary. One year after Eric's death, Kouri published a children's book about a father watching over his son from heaven. Four weeks later, she was arrested. The defense maintains her innocence. 📂 PLAYLISTS & RESOURCES 🌐 Website: https://justiceisaprocess.com ► Full Trial Live Broadcasts: • LIVE BROADCAST: UT v.
