Photos accessed immediately after Eric died 18:33 - 911 Call from Kouri Richins 19:35 - Defense Opening Statement - Kathryn Nester ➡️ The Prosecution's Case (State of Utah) • Financial Motive (3:05): The prosecution argues Kouri murdered her husband, Eric, for his money and a "fresh start". Kouri owed over $4.5 million to various lenders and was about to close on a $3.2 million mansion she could not afford. She believed Eric's death would leave her with his $4 million estate, including his business, their home, and nearly $2 million in life insurance. She also wanted to build a new life with her boyfriend, with whom she had booked a Caribbean vacation and planned a future. • Prior Attempted Murder (2:09-2:15, 9:43-10:20): The state alleges Kouri attempted to poison Eric on Valentine's Day, two weeks before his death, by lacing a sandwich she bought for him. He became severely ill and his phone activity ceased for 90 minutes. • Procuring Fentanyl (9:01-9:32, 10:35-11:08): Kouri used her house cleaner, Carmen Lauber, to buy illicit pills from a street dealer shortly before Valentine's Day. After Eric survived the sandwich incident, Kouri asked Carmen for "something stronger," and Carmen purchased more pills just five or six days before Eric died. • Cause of Death: Eric's autopsy and toxicology report revealed he died from an intentional, lethal dose of fentanyl, with large amounts found in his blood and stomach. • Cover-Up and Guilty Conscience: On the night of his death, Kouri delayed calling 911 for at least 15 minutes after discovering Eric's body (12:15-12:38). Afterward, she bought a new phone, deleted text messages, and searched the internet for things like "How to permanently delete information from an iPhone remotely," "If someone is poisoned, what does it go down on the death certificate as?", and "prisons for the rich in America". The prosecution also highlighted that she published and promoted her children's grief book, Are You With Me, while knowing she was under police investigation for his death. ➡️ The Defense's Case: Kathryn Nester for #KouriRichins • Lack of Physical Evidence & Poor Investigation: The defense emphasizes that after a four-year investigation, there is zero evidence showing how fentanyl entered Eric's system. Police failed to properly search the bedroom or the house, and they left the cups Eric and Kouri drank from sitting in the sink without ever testing them. Furthermore, the medical examiner has never been able to officially determine the manner of Eric's death, which remains listed as "unknown". • Eric's Secret Drug Use: Eric suffered from severe chronic pain due to hard labor and Lyme disease, but hid his weakness because he was a "macho" outdoorsman. He relied heavily on marijuana gummies (which police found scattered through his belongings) and would even smuggle pain relievers on international trips. He also had an expired bottle of hydrocodone by his bed the night he died, and had recently traveled to Mexico, a known source of fentanyl. • Disputing the Murder Weapon: Kouri admits she asked Carmen to buy pain pills for Eric at his request, but she asked for Oxycodone, not fentanyl. The street dealer confirmed he only sold 30-milligram Oxycodone pills at that time, and the autopsy showed absolutely no Oxycodone in Eric's system. The defense claims Carmen only changed her story to say Kouri asked for "fentanyl" after police threatened Carmen with heavy state and federal prison time for unrelated crimes. • Flawed Motives: The defense argues Kouri had no financial motive to kill Eric because she was about to make a $2 million profit on the Midway Mansion deal. Additionally, Kouri already knew before Eric died that his assets were protected in a trust run by his sister, meaning she knew she wouldn't automatically inherit everything. • Family Bias and the Valentine's Day Incident: Eric's family immediately blamed Kouri and paid a private investigator almost $100,000 to dig up dirt on her and feed it to the police. The defense dismisses the Valentine's Day "poisoning" as a minor incident that Eric laughed off and never saw a doctor for, noting that people who use pain pills often have allergic reactions matching the symptoms Eric experienced. #KouriRichins Trial Playlist: • Kouri Richins Murder Trial
