What Is Dangerous Driving? | Types Of Traffic Offences | Section 2A Of The Road Traffic Act 1988. In the UK, driving offences tend to fall into two main categories which are; dangerous driving and careless or inconsiderate driving. In this video the focus will be on dangerous driving. which is more serious offence than careless driving. It doesn't mean careless driving isn't important. We will discuss about it in our subsequent video. So you asked about What is dangerous driving? What Offences Are Classed As Dangerous Driving? What says the law ? Let's answer all these questions. According to the UK's driving laws , You can commit the offence of dangerous driving in two ways. Either because the standard of your driving is very poor or simply because your vehicle is in very bad condition. In relation to the standard of your driving which is the first way of dangerous driving , section 2A of the Road Traffic Act 1988 explains that, you will be regarded as driving dangerously if the way you drive falls far below what would be expected of a competent and careful driver and it would be obvious to a competent and careful driver that driving in that manner or way would be dangerous. However, It will be a matter for a magistrate’s court to decide whether your driving has fallen 'far below' the required standard. It's important to note and remember that the term dangerous here refers to a danger of personal injury or of serious damage to property. Examples of dangerous driving include speeding, driving aggressively, overtaking dangerously, driving under the influence of drink or drugs. Falling asleep at the wheel would also be classified as dangerous driving. In our subsequent video we give more details regarding falling asleep at the wheel or driver fatigue. Do you know that using a hand-held mobile phone, looking at a map or otherwise being distracted are also deemed to be causes of dangerous driving. However driving under the influence of alcohol or drugs is a specific offence but can be classed as dangerous or careless driving. In relation to the condition of your vehicle which is also classed as dangerous driving, section 2A of the Road Traffic Act 1988 explains that a person is to be regarded as driving dangerously if it would be obvious to a competent and careful driver that driving the vehicle in its current state would be dangerous. So , the defects or condition must be able to be seen at first glance, otherwise they cannot be 'obvious'. However, if you drive knowing your vehicle has a serious defect, even if it is hidden, you can still commit the offence of dangerous driving and be prosecuted. For information, dangerous driving offences will be dealt with by the Magistrates' Court or Crown Court, depending on the seriousness. If found guilty, you could be hit with an unlimited fine, a driving ban and up to 14 years in prison. It's worth noting that Dangerous driving is more serious than careless driving.
