Criminal charges may hinder many people, especially minorities, from attaining employment and positioning themselves so that they do not repeat similar patterns of mistakes. Many economically challenged people have to depend on court appointed attorneys or even some paid attorneys that may not give them an appropriate representation or sometimes feel like those same attorneys are fighting against them. Therefore, I’m showing people how I expunged some charges off of my criminal record in the state of VA without having to pay an attorney for something you can easily do yourself. Unfortunately, this method only works if your disposition was null process, dismissed, or the original charge was reduced or acquitted. The information provided in this post is for general informational purposes only and does not constitute legal advice. Please consult with an attorney regarding your specific situation. 1.) Go to vacourts.gov (http://vacourts.gov), in the search bar at the top of the page type in cc1473 if the final disposition was in circuit court or type dc363. Click on the Petition for expungement filed in circuit court or Petition or Motion for Expungement. 2.) the forms are self explanatory and must be submitted in the court where the trial occurred, but I guess I can summarize a portion of the process. Make about 3-4 copies of this form because you may have to submit copies to the commonwealth attorney, the arresting agency or police department and the clerk’s office. 3.) You can get most of the information such as case number, address of the court, etc from the clerk’s office where you were tried. 4.) Go to the a police department to get a set of your fingerprints made, this will usually cost $5 per set of finger prints. You will need one set per separate charge. You may have to give them a copy of the form. 5.) Go back to the clerk’s office of the court you were tried in to submit the form you filled out along with the set of fingerprints you got from the police station. Sometimes the police station may submit the fingerprints to the court themselves. Another copy may have to be given to the commonwealth attorney. Wait for their decision. 6.) Sometimes you may have a court date set if the state prosecutor wants to dispute your petition. #expunged #legal #backgroundchecks
