Portland Meadows | 198 P.2d 847 (Or. 1948) Amphitheaters, Incorporated versus Portland Meadows features a dispute between two businesses taking advantage of mid 20th century electricity offerings to sell nighttime entertainment. Portland Meadows bought some undeveloped land outside of Portland and built a racetrack. It mounted 350 1500-watt lights on 80-foot poles around the track and proudly advertised the fact that night races would be lighted. A few months later, Amphitheaters, Incorporated built a drive in movie theatre on the property adjoining the racetrack. It erected tall fences to block light from an adjoining highway and constructed a shadow box around the screen to exclude moonlight and starlight. It turned out that this wasn’t enough to block all ambient light. The movie theater and the racetrack opened within two weeks of each other. Reflected light from the racetrack spilled over onto the movie screen. This light from the racetrack was about as bright as the full moon and made it hard to see the pictures on the screen. On at least one occasion, Amphitheaters had to refund admission fees to patrons who couldn’t see the movie they’d paid to watch. Amphitheaters immediately complained to Portland Meadows. Portland Meadows installed hoods on the lights closest to the movie theatre and added some louvers to its property. This helped some but didn’t eliminate the spillover. Amphitheaters sued Portland Meadows. It alleged that by casting light onto Amphitheater’s screen, Portland Meadows had committed a trespass on real property and a private nuisance. The trial court directed a verdict for Portland Meadows. Amphitheaters appealed to the Oregon Supreme Court. Want more details on this case?
