In this case, the petitioner was convicted of disturbing the peace for making inappropriate advances towards an 18-year-old hitchhiker. The Mississippi Supreme Court initially overturned the conviction because evidence obtained through an unlawful search was improperly admitted. However, they later reversed their decision, stating that the petitioner's failure to object to the evidence at the right time meant he waived his constitutional rights. The Supreme Court vacated the conviction, sending the case back to Mississippi to determine if there was a valid waiver or not. Henry v.
