E-cigarette industry facing tougher EU rules

(11 Apr 2017) LEADIN: At Vape Jam - the UK's largest e-cigarette and vaping show - the subject of stricter EU regulation of e-cigarettes and liquids is on everybody's lips. Next month, the 12-month transition period of Article 20 of the Tobacco Products Directive (TPD) comes into force - this will restrict the quantity and potency of e-liquid available to buy. STORYLINE: The air is filled with vapour clouds in hundreds of different flavours. Vapers are filling their lungs at Vape Jam 3 in London's ExCel. It's approaching the end of an important transition period for the vaping industry as EU regulation tightens its grip on the relatively new alternative to smoking. Article 20 of the EU's Tobacco Products Directive (TPD) will come into force on 20 May, 2017. It was introduced a year earlier, but came with a phased 12-month transition period. The new regulations will restrict the size of the bottle that e-liquid is packaged in to a maximum of 10 ml. The refillable tank size of an e-cigarette is being limited to 2ml which means vapers will either have to fill up the tank more often or vape less. The nicotine content of e-liquid will not be allowed to exceed 20mg or 2%. The max concentration of nicotine generally available at present is 3.0% or 30 mg/ml nicotine. Dave Dorn is a trustee for the New Nicotine Alliance (NNA) - a group which works for what it calls 'tobacco harm prevention' through promoting alternatives to smoking without necessarily giving up nicotine. He is trying to gather support at the show and is speaking to vapers about the NNA's work. Dorn is against the TPD's restrictions on e-liquid quantity and potency and believes by making vaping less attractive to smokers looking to kick the habit then there's less chance they will manage to quit. He says: "In days gone by, in years gone by, somebody who was considering taking up vaping for whatever reason, could buy whatever device, whatever liquid in whatever flavour, and whatever quantity they wanted. As it stands now, new vapers, smokers if you will, that are moving to vaping may well find that what they are taking up, because it's in such small quantities, is such a fiddle and a faff that they don't get the pleasure out of it that they get out of smoking and that's important. This is the pleasure principle in action. People enjoy smoking, people have got to enjoy vaping more or they'll keep on smoking." But not everybody in the vaping industry agrees with Dorn. Chris Dodge is secretary general of the Global Vaping Association - an international trade association for vaping - and also the managing director of Vape House, a fast growing chain of vape shops across Europe. Dodge believes the industry needs to be responsible and accept regulation where necessary. He also doubts Dorn's claim that a cap of 20mg nicotine liquids will dissuade smokers from vaping. "Now the average smoker smokes a cigarette and it basically has 8mg of nicotine and then he (Dave Dorn) wants you to think that to get off that 8mg of nicotine you have to vape over 20mg. I can tell you right now, in our franchises the most popular strength is 3mg, the second most popular is 1.5. We rarely sell six and we almost never sell anything stronger than six. So when the public comes in, two pack a day (of cigarettes), we try to put them on a 6mg they're usually coming back quickly and saying I want a three," he says. One of the criticisms often levelled at the vaping industry is that rather than trying to convert smokers to vaping, it is targeting a new generation of young vapers.
