Can I drive if I have a medical marijuana Rx? Apart from treating whatever condition you have, the beauty of a medical marijuana Rx in FL is that you can lawfully possess, and use, medicinal marijuana in FL. However, lawfully being able to possess and use medicinal marijuana doesn’t give you Carte Blanche to do so anywhere and everywhere and at all times. When it comes to the subject of driving, if your “normal faculties” are provably impaired by either alcohol or by a controlled substance - which would include marijuana - medicinal or not - then you can be arrested, and even convicted, of DUI. So “can you drive” if you have a med-mar Rx? Yes, but you can’t do so lawfully if you’re so banged up that your “normal faculties” are provably impaired. By the way, this holds true for any and all controlled substances, Rx or not. So if you’re prescribed Ambien or another sleeping pill, or Xanax or another Benzo, or Percocet or another opiate... the fact that you have a Rx for the controlled substance won’t indemnify and hold you harmless from a DUI arrest, prosecution or conviction...
