And back in the 90s when it began, they had done better testing on the meshes that they used. The FDA required some testing to show it was safe. And then as the years went on, once they had the approval, they can make small modifications to quote unquote "improve" the mesh, and those "improved" products turned out to have some flaws. The modifications they made actually caused harm. And so there were a bunch of people who started experiencing pain. They'd have a lump where the hernia mesh was inserted. They would have abdominal pain. Sometimes they would have major problems in their bowels. These are not minor pains. These are major, very, very difficult aggressive pain that doesn't go away, that interferes with sleep, that is around 24 hours a day. So the people who have this happen become very unhappy and very sick. The only way a person who has this problem is going to be compensated for what they go through, which can include their future medical bills or maybe they're not able to work, they've lost income, is to file a lawsuit. I'd say 99.9% of the people who come to my office say when we start talking about filing a lawsuit for their for their losses, they say "Well I'm not the kind of person that would file a lawsuit. I wouldn't really normally do this, but I don't want anybody else to have happen to them what happened to me." Lawsuits can encourage manufacturers to remove products from the market that are harming people because they have to pay for it. Unfortunately in the world of products liability, it takes sometimes money that makes them think we should do something differently.
