I was trespassed from a public building in the city of Tampa, Florida simply because I did not sign in under their building-policy — a policy, not a law. Then I appealed under the precedent set by Katron v. City of St. Petersburg (which requires an independent hearing officer for citizen appeals), and discovered that Tampa’s process forces me to appeal directly to the Tampa City Attorney’s Office — the very same office that represents the police department and the City. This creates a clear conflict of interest and denies me an impartial adjudicator, violating due process under the U.S. Constitution’s 14th Amendment and Article I, Section 9 of the Florida Constitution. I’ll walk you through: the building policy vs. law distinction how the trespass order lacks lawful basis the lack of a neutral hearing officer and its constitutional implications why Tampa’s process is fundamentally unfair If you’ve ever been told you must sign in or face exclusion from a public building — or ever had a trespass notice without meaningful appeal — this is for you.
