In her introduction to this edition of the UPC podcast, Emily had this to say: "So we have this new court coming online this year, which is going to be a big change for Europe, not just in terms of the number of jurisdictions that it covers, but also in terms of the adverse party costs or cost shifting. So the loser pays the principal. Some European jurisdictions have this to some extent, such as Germany, which has statutory fees, which are payable in the event of loss, but others don't. And so this, I think, will be quite a different dynamic for some of the litigators who are going to operate in this new court."
