California | 376 U.S. 483 (1964) The Constitution’s Fourth Amendment protects American citizens from unreasonable searches and seizures, including most warrantless searches. The United States Supreme Court considered whether a warrantless search of a hotel guest’s room, conducted with only a hotel employee’s consent, violated the Fourth Amendment in Stoner versus California. One October night in nineteen sixty, two men robbed a grocery store in Monrovia, California. Eyewitnesses at the scene reported that one of the robbers was wearing a pair of horn-rimmed glasses and a grey jacket. He was also carrying a gun. A checkbook found in the parking lot belonged to Joey L. Stoner, a man with a criminal record whose photo, said eyewitnesses, resembled the man with the gun. The checkbook ultimately led police to the Mayfair Hotel in Pomona, California, where Stoner was a guest. The police had no warrant, and Stoner was currently out, so they asked the hotel clerk for permission to search Stoner’s room. The clerk happily gave permission and unlocked the door to Stoner’s room, in which the police found horn-rimmed glasses, a grey jacket, and a gun. Two days later, Stoner was arrested in Las Vegas, Nevada. After being handed over to California, Stoner stood trial for armed robbery in California state court. His objection notwithstanding, the items found in his hotel room were admitted into evidence, and he was convicted as charged. The California Court of Appeal affirmed, and the California Supreme Court denied further review. Stoner appealed once more, this time to the United States Supreme Court.
