Michigan State Police Pursuit In Saginaw

While on patrol, I (Sergeant Kemerer) was stopped on Genesee near Bond facing east. I observed the suspect vehicle pass by traveling east on Genesee. As it did, I obtained the vehicle registration plate which showed it was registered to a Jeep, however, the suspect vehicle was not a Jeep. I caught up to the suspect vehicle near Michigan and confirmed it was a Ford. A traffic stop was initiated by activating the patrol car emergency lights west of Niagara and I approached the driver/lone occupant. I asked the driver for his license and vehicle paperwork. While he was looking for them, I observed a clear plastic baggie on the driver’s lap. While he continued to move around, I observed the baggie to contain a white substance I suspected to be cocaine. I then ordered the driver not to move as I reached in to grab the baggie. I had to push the driver’s left hand away as he attempted to block my reach. The driver then put the vehicle in drive and fled east on Genesee. I ran back to my patrol car, activated the patrol car emergency siren and began pursuing the vehicle. I notified Saginaw Central Dispatch of the information as the vehicle continued east/south on Genesee. While traveling south on Genesee the patrol car speeds reached approximately 100 mph without appearing to close the distance significantly on the suspect vehicle. There were no other vehicles on Genesee in this area. The suspect vehicle right turn signal then came on and the vehicle turned right (west) onto Walnut. However, the vehicle couldn’t negotiate the turn, drove over the curb on the left side of the roadway and struck a utility pole. As I pulled up to the suspect vehicle, I saw shadows moving indicating the driver was fleeing on foot. I drove west on Walnut and observed the driver running westbound on the street. The driver was holding his waistband/reaching into his waistband, which indicated to me from my training and experience that he may be in possession of a weapon/firearm. The suspect then ran south over a snowbank and toward a building (Larry’s Auto Supply) as I exited the patrol car and gave loud verbal commands for him to stop and show me his hands and I also drew my primary firearm. The driver refused all commands and continued running on foot south around the building. I ran around the sidewalk to Hoyt as I observed the suspect also running onto Hoyt. I continued to give loud verbal commands for the subject to stop and show me his hands/put his hands up. The suspect then did stop in the street but turned his back to me while continuing to reach into his front waistband. I pointed my firearm at the suspect while ordering him to get on the ground and show me his hands, as I again believed he was possibly reaching for a weapon. The suspect then complied with commands and got on the ground with his hands in front of him. Troopers Turnquist and Barber arrived at my location at that time, and I instructed Trooper Barber to place the suspect in handcuffs. Trooper Barber then placed him in handcuffs. The suspect identified himself as Kevin Shacks. A search of his person located no contraband, but Shacks did have multiple knives on his person. He was taken into custody approximately two minutes after my initial stop. The area where the pursuit was initiated on Genesee is a posted 30 mph zone that turns into a posted 25 mph zone on the Genesee St. Bridge, making the charge flee and elude 3rd degree. A search of the vehicle was conducted at the scene. During that search, Trooper Weston located the baggie of suspected cocaine (Property Item #1) that I had observed on Shacks’ lap upon my initial contact. This baggie was located on the driver side floorboard between the driver seat and door. In further checking of the area, Trooper Hatt located a folded lottery ticket containing suspected crack cocaine (Property Item #2) on Walnut in Shacks’ route of foot travel.
