Related to the prior video on precedent found here on the channel, today we’ll talk a little about the US federal court system. The US federal system has 3 levels, the US Supreme Court, the US Courts of Appeals and the federal district court. The Supreme Court is unique in that it can also hear direct appeals from the Supreme Courts of all the US states - the lower federal courts can not do so. The first layer in the federal system are the district courts. These are the front line courts where most cases are originally filed and ruled upon by judges and/or juries. There is at least one district court in each state and the District of Columbia. There are 94 federal districts across the US. The 94 district courts are spread across 12 geographic circuit courts of appeals. The district courts only have to follow precedents from the appeals circuit to which they belong, and of course the Supreme Court. There is also a “Federal Circuit '' that, unlike the geographic boundaried circuits, is national in scope, but limited to patent cases & similar topics. We’ll learn more about the Federal Circuit soon. But for now it is important to note that the geographic circuits do not have to follow each other’s precedent and disagreements between them - called “circuit splits” - can eventually get resolved by the US Supreme court.
