Some shop owners are receiving emails this week from transaction processing merchant services explaining that they will no longer process transactions for e-liquids. Find out more on this edition of Ruthless Insider. — Source Email Text: To whom it may concern, As your payment card processor, EVO Merchant Services, LLC (“EVO”) is sending you this important notice to advise you that as a result recent changes in state laws and federal enforcement initiatives regarding electronic nicotine delivery systems (“ENDS”), EVO will no longer be processing transactions for flavored e-liquids. EVO is providing you with this notice because some of the products and services sold by your business, as identified by you on your Merchant Application, may be impacted.As a reminder, per the terms and conditions of your Merchant Processing Agreement (“MPA”) with EVO, you are solely responsible for ensuring your business’ compliance with state and federal laws and card brand rules. If it is discovered that your business is selling flavored e-liquids or any tobacco products in a manner which could be considered a violation of any applicable law or card brand rule, EVO will not hesitate to exercise its rights under the MPA, which include but are not limited to: holding all funds generated from your sales transactions; closing your merchant account without prior notice; and reporting your business for inclusion in the Terminated Merchant File.Finally, none of the information contained in this notice constitutes legal advice or acts as a substitute for your own review of the applicable laws and card brand rules.
