The Gauteng High Court in Pretoria has heard that there is no reasonable prospect of success if the court were to grant the Home Affairs Minister leave to appeal the judgment which ruled against him in the challenge to the termination of the Zimbabwe Exemption Permit. Motsoaledi previously stated that the June judgments set a "dangerous precedent". In June, the full bench declared the Minister's decision to terminate the ZEP, grant a limited 12-month extension and refuse extensions beyond 30 June 2023 unlawful, unconstitutional and invalid. In a second judgment, the court granted the Zimbabwean Immigration Federation an interim interdict pending the outcome of Part B of its application. This restrains government respondents from detaining or deporting any holder of a ZEP. The Permit allows close to 180 thousand Zimbabweans temporary legal status to live, work and study in South Africa. Adv Carol Steinberg SC, on behalf of the Helen Suzman Foundation, who are opposing the application, submitted that there is no evidence that the Minister applied his mind.
