Often, the expert recognizes the incapacity but states that the date of its onset is the same day it occurred. This does not make sense. It is not credible that the insured became incapacitated on the day of the expert assessment, whether it is a judicial expert assessment or an administrative expert assessment. Theme 343 of the TNU provides that it will only be possible to recognize that the Incapacity Start Date began on the day of the expert assessment itself when there is solid evidence to that effect.
