Around 10:40 PM on October 8, 2024, Officer Joshua Baar with the Tampa Police Department was called to the parking lot of 1901 E 7th Avenue on a report of a grey 2012 BMW that had backed into another police car. Since there was no significant damage to either vehicle, they determined that a crash report was not needed. After speaking with the other officers on scene, Officer Baar made contact with the driver, who was identified as Elsie. As he was speaking with her, he observed indicators of impairment and detected the odor of alcohol. She also admitted to consuming beer earlier that evening. Based on his suspicion of impairment, Elsie was asked to exit the vehicle and perform field sobriety exercises. Officer Baar started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. The final exercise was the One Leg Stand test. Based on the motor vehicle accident, her indicators of impairment, the odor of alcohol, her admission to consuming alcohol earlier that evening, and her inability to adequately perform the field sobriety exercises, Elsie was placed under arrest for driving under the influence. As he was placing her in the police car, Elsie kicked Officer Baar. After being placed inside the police car, Elsie was transported by Officer Baar to the Hillsborough County Sheriff’s Office for further processing. At the jail, she refused to submit to a breath test. She was charged with a DUI (316.193(1)) and resisting officer without violence (843.02).
